TERMS AND CONDITIONS OF SALE
§. 1 General conditions of sale
The user of this website will access the Acquerello Shop (www.acquerello.shop). By visiting the website and placing an order on the site, the user accepts the Terms and Conditions and the data security policies adopted by the site and set out below.
These General Terms and Conditions of Sale apply exclusively to sales made on the Acquerello Shop website, in accordance with Part III, Heading III, Paragraph I of the Italian Consumer Code ((D. Lgs. N. 206/05 as amended by D. Lgs. N. 21/14 and D. Lgs. 70/03) by:

The user is required, before accessing the products supplied by the website, to read these Terms and Conditions of Sale, which are wholly and unequivocally accepted at the time of the purchase.
The user is invited to download and print out a copy of the purchase form and the Terms and Conditions of Sale. Acquerello Shop reserves the right to unilaterally amend said Terms and Conditions, without prior warning.
It is possible to use the website and to read description of the products available in the following languages:
Italian, English, French, German.
§. 2 Subject
These General Terms and Conditions govern the offer, the forwarding and the acceptance of purchase orders for products on the Acquerello Shop website. They do not cover the supply of services or the sale of products by subjects other than the seller, which may be present on the site through links, banners or other hyperlinks.
Before forwarding orders and purchasing products and services from other subjects, we recommend verifying the terms and conditions of sale.
§. 3 Conclusion of the contract
The sales contracts of products present on the website are to be considered concluded when Acquerello Shop has accepted the order, also only partially. This acceptance is communicated via e-mail in the form of a confirmation of the order. By forwarding an order using the order form, the user declares that they have read and accepted all the Terms and Conditions set out herein and therefore also the conditions of payment.
Before concluding the contract, the user will be asked to confirm that they have read the General Conditions of Sale, including the information on the right of withdrawal and the processing of personal data.
The contract is concluded when the seller receives payment, following verification of the information transmitted.
The purchaser shall pay the price of the goods as soon as the online order has been transmitted. This will occur when the button ‘Pay now’ is clicked at the end of the guided procedure.
Once the contract is concluded, the seller will forward the order for shipping.
§. 4 Registered users
By completing the registration procedure, the user agrees to follow the indications set out on the website and to supply personal data correctly and truthfully.
Confirmation shall exonerate Acquerello Shop from any liability regarding the data supplied by the user. The user agrees to promptly inform Acquerello Shop of any changes in the personal data supplied.
Should the user provide inexact or incomplete data, or should there be any complaints by the subjects involved regarding the payments made, Acquerello Shop shall have the right to cancel or suspend the service until the sums due have been paid.
When the user first registers, Acquerello Shop will provide a username and a password. The user understands that the username and password are the validation system for user access to the Shop, they are the only way of identifying the user and any activities carried out following this access will be attributed to the user and will have binding effect on said user.
The user agrees to keep the access data secret, to store it with due care and attention and not to grant it, even temporarily, to third parties.
§. 5 Availability of the products
The availability of the products refers to the effective availability at the moment the client places an order. This availability must, in any case, be considered purely indicative, since the presence on the website of a number of users may mean that the products are sold to other clients before the order is confirmed.
Also following the transmission of confirmation of the order, the goods may be partially or totally unavailable. In this case, the order will be automatically rectified by eliminating the product not available and the purchaser will be promptly informed by e-mail.
Should the purchaser ask for the order to be cancelled, terminating the contract, the Acquerello Shop will reimburse the sum paid within 14 (fourteen) days from the moment in which Acquerello Shop is informed of the client’s decision to withdraw from the contract.
§. 6 Products offered

§. 7 Payment methods and prices
The price of the products is that shown on the website, except where there is an evident mistake.
If an error has been made, Acquerello Shop will promptly inform the client, allowing them to either confirm the order at the correct price, or to cancel the order. Acquerello Shop shall not, under any circumstances, be obliged to supply the goods at a lower price indicated erroneously.
The prices on the website include VAT and shipping costs. The prices may vary at any time. The price changes will not involve any orders for which order confirmation has already been sent.
Once the products have been selected and added to the trolley, it will be sufficient to follow the purchase instructions, inserting or verifying the information requested at each stage in the process. The details of the order can be amended prior to payment.
Payment can be made using PayPal and credit cards.
§. 8 Delivery
Acquerello Shop ships to the following countries: Italy, Austria, Germany, and France.
Delivery is made as per the terms and conditions by the date indicated. Should the delivery date not be specified, delivery will be made by the deadline estimated when the shipping method is selected and, in any case, within a maximum of 4 (four) days from the date of confirmation of the order.
Should it be impossible to make the delivery, the order will be returned to the warehouse. In this case, the client will be informed of the place the order is being held and how to organise a second delivery.
It the client cannot be present to receive the delivery on the day and at the time agreed, they should contact the company to agree on a new delivery date.
It if it is not possible to make the delivery after 7 (seven) days from the date the order was ready for delivery, Acquerello Shop will assume that the client intends to withdraw from the contract.
As a result of the termination of the contract the sums paid will be reimbursed without delay, and in any case within 14 (fourteen) days from the date of termination of the contract, including delivery costs, except for any additional costs arising from the choice of a method of delivery other than the ordinary method offered. Additional transport costs resulting from the termination of the contract shall be paid by the client.
The shipping costs are the client’s responsibility and are specifically listed when the order is placed.
§. 9 Passing of risk
The risks related to the products shall pass to the client from the time of delivery. The ownership of the products is considered acquired as soon as the full payment of all the amounts due in relation to them has been received, including shipping costs, or at the time of delivery, if this takes place at a later time.
§. 10 Warranty and commercial conformity
The seller is responsible for any defect in the products offered on the website, including the non-conformity of the articles to the products ordered, in accordance with Italian legislation.
If the client has signed the contract as a consumer, that is, a natural or legal person acting on the site for purposes unrelated to any business or professional activity, this warranty is valid: a)providing the defect occurs within 24 (twenty-four) months from the date on which the defect was acknowledged by the latter; b) the online return form is completed correctly.
In the case of non-compliance, the client who signed the contract as a consumer will have the right to obtain the restoration of the conformity of the products, without expense, by repair or replacement, or to obtain an appropriate price reduction or the termination of the contract in relation to the disputed assets and the consequent reimbursement of the price.
All return shipping costs for defective products shall be paid by the seller.
§. 11 Withdrawal
In accordance with current legislation, the client has the right to withdraw from the purchase agreement, without penalty and without specifying the reason, within 14 (fourteen) days, pursuant to Article 57 D. Lgs 206/2005, starting from the date of receipt of the products.
The client who intends to exercise the right of withdrawal must inform Acquerello Shop through an explicit declaration, which may be sent by registered mail or through the section Shipping and Returnson the Acquerello Shop website, where the return will be registered.
The client must exercise the right of withdrawal either by sending an explicit declaration setting out the decision to withdraw from the contract or, alternatively, by transmitting the standard withdrawal form, as per Appendix 1, Part B, D. Lgs 21/2014 (not compulsory).

The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached tax documentation.Without prejudice to the right to verify compliance with the above, the site will reimburse the amount of products subject to withdrawal within a maximum period of 14 (fourteen) days, including any shipping costs.
As foreseen by the Article 56, paragraph 3 D. Lgs 206/2005, amended by D. Lgs 21/2014, the site may suspend the reimbursement until receipt of the goods or until the client demonstrates that they have returned the goods.The website will reimburse the sums paid using the payment method chosen by the client at the time of purchase. In the case of payment made by bank transfer, and if the purchaser intends to exercise the right of withdrawal, bank details: IBAN, SWIFT and BIC needed to make the repayment must be provided.

The data is processed exclusively by electronic means, using IT tools and applications designed to safeguard the security and confidentiality of the data.
The information stored is protected from unauthorised access.
We will process the data supplied by users relating to purchases and payments (which may include the name, address, contact numbers or e-mail addresses), IP address and any other data supplied.
The purpose of this data processing is:
- to supply purchases (sales) and receive payments (accounting and taxes);
- to send informative and promotional material relating to the activities and services of the website and/or offers of a commercial nature concerning our subsidiaries and commercial partners (commercial purposes).
It is necessary, in order to fulfil an order and receive the relative payment, to give consent to the processing of the personal data supplied. Refusal to supply said data or to give consent to the processing of the data will make it impossible for the user to purchase the products and services offered.
It is not compulsory to supply personal data or to consent to the processing of said data, however a refusal to do so may mean that it is impossible to receive any further service.
The data supplied will be communicated to companies contractually linked to Rondolino Società Cooperativa Agricola that carry out third-party services including payment and shipping (specifically, couriers).
The data will not be transferred to EU Member States or to countries outside the European Union.
The user has the right to:
- access their data or to obtain from the Data Controller confirmation that personal data is being processed;
- to request that the data be updated, corrected or integrated;
- to request cancellation, transformation into anonymous form or blocking of data processed in violation of the law including those that do not need to be kept for the purposes for which the data was collected or subsequently processed, the attestation that the operations have been brought to the attention, also as regards their content, of those to whom the data has been communicated or disseminated, except in the case in which this fulfilment proves impossible or involves a use of means clearly disproportionate to the protected right;
- to object, in whole or in part, to the processing of personal data concerning him/her for legitimate reasons, even if pertinent to the purpose of the collection and processing of personal data concerning him/her for the purpose of sending advertising or sales material direct or for carrying out market research or commercial communication;
- to limit the processing (in cases where the accuracy of personal data is contested).
The user can also cancel consent to the processing of their data previously given by sending a specific request by e-mail: email@example.com.
Ont the first visit, the user will be invited to choose their language and will offer the possibility to save the language of preference. To this end, the user authorizes the use of the identification codes c.d. cookies, i.e. small files sent from your internet server and recordable on the hard drive of the user's computer.
The hard disk collects information about the user's language preference and stores the pages of the site visited. Cookies are used in order to avoid that the user receives the same information repeatedly or in the wrong language, and to adapt the content and presentation of the site to the type of user's browser.
§. 13 Safeguard clause
Should any of the clauses in these General Conditions of Sale be null and void for any reason, this shall not affect the validity and compliance with the other provisions set out in these Terms and Conditions of Sale.

§. 15 Applicable legislation and place of jurisdiction
The contract of sale between Acquerello Shop and the client, as per these General Conditions of Sale, is concluded in Italy and governed by Italian Law. The place of jurisdiction for all controversies arising from the conclusion of sales contracts referred to in the portal and therefore referable to these General Conditions of Sale, if the user is a consumer, shall be the municipality of residence of the consumer, in all other cases the territorial jurisdiction is exclusively that of the Court of Vercelli.
